I am listening to a bunch of legal mumbo jumbo on TV. If I was arguing this before the high court, I would propose this.

For a child to become an American Citizen the parents have to be a resident. They actually have to live here for a minimum of 5 years. No more coming to this country, having a child and going home just so the child is a US citizen. Yes, that means even illegals. Now if the parents are deemed to be illegal, they should have the opportunity to plead for asylum. If asylum is not warranted, 2 years in a minimum-security correctional facility, court costs and a fine, just like any American caught breaking the law. While detained the migrants should have the opportunity to go through the process to become legal US citizens when they get out.
 
The 14th Amendment states the parent has to be under the jurisdiction of this country. That means tourists would not be eligible nor would an individual who was a citizen of another nation and not a citizen of this nation. It was never the intention of the authors of the 14th amendment to grant citizenship to any infant born in this country. The application of the amendment to include all babies born in this land has been a miscarriage of justice and hopefully the Supremes will see there way to correct this misapplication of law
 
The father must be subject to the jurisdiction of this country, as stated in the 14th Amendment. Therefore, no tourists nor foreign nationals who are not citizens of this country would be eligible. Those responsible for drafting the 14th Amendment did not intend for it to automatically confer citizenship on any child born in the United States. Hopefully, the Supreme Court will find a way to rectify the injustice caused by the expansion of the amendment to encompass all kids born in this country.
